These Terms of Service ("Terms") apply to the use of the online service provided at docreate.io. The provider is Bergmeier & Bergmeier GbR ("Provider"). The user is any natural or legal person who uses the service ("User"). By registering or using the API, you agree to these Terms.
1. Scope of Services and Subject Matter
docreate.io provides an API for the creation of PDF documents and marketing materials. The specific scope of services is determined by the product variant selected and the respective product description on the website. The Provider performs the services according to the state of the art; the User has no claim to specific features or technical characteristics unless expressly agreed or described.
2. User Responsibility for Submitted Content
The User is solely responsible for all content submitted via the API or the platform (texts, images, data, and other inputs). The User ensures that they have all necessary rights to such content and that submission and processing by the Provider do not infringe any third-party rights. The User shall indemnify the Provider against any third-party claims arising from a breach of these obligations.
3. Prohibition of Illegal Content
The submission and use of content that violates applicable law (e.g. criminal, anti-competitive, copyright-infringing, or personality-rights-infringing content) is prohibited. The Provider is entitled to refuse processing or to block access where there are concrete indications of a legal violation. In the event of serious or repeated violations, the contract may be terminated without notice.
4. Availability; No Claim to Permanent Accessibility
The Provider endeavours to maintain high availability of the service. The User has no claim to permanent or uninterrupted availability. Maintenance work, technical faults, or force majeure may lead to restrictions or outages. Planned maintenance will be announced in advance where reasonably practicable.
5. Liability
Except in cases of statutory liability for death, personal injury, or damage to health, the Provider shall be liable only for intent and gross negligence. In cases of slight negligence, the Provider shall be liable only for breach of essential contractual obligations (cardinal obligations) and only for foreseeable, typically occurring damage. In such cases, liability is limited to the foreseeable, contract-typical damage at the time of conclusion of the contract. The foregoing limitations of liability apply accordingly in favour of the Provider's vicarious agents. Where liability is excluded or limited, this also applies to liability for defects.
6. Payment Terms
Paid services are processed via Stripe. Stripe's terms of service also apply.
7. Conclusion of Contract, Term, and Termination
The contract is formed upon registration and acceptance by the Provider or upon use of paid services. The term and notice periods are determined by the tariff option selected. The right to terminate without notice for good cause remains unaffected. In the event of breaches of these Terms, the Provider may suspend or permanently block access.
8. Amendments to the Terms
The Provider is entitled to amend these Terms with effect for the future. Amendments will be communicated to the User in text form (e.g. by email or notice in the customer area). If the User does not object within four weeks of receipt of the notice, the amended Terms shall be deemed accepted. The notice will inform the User of the objection period and the legal effects of silence.
9. Final Provisions
The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes shall be the Provider's place of business, to the extent permitted by law. If any provision is or becomes invalid, the validity of the remaining provisions shall not be affected.
